Professional Indemnity Insurance (PII)

Every practicing Nurse and Midwife needs insurance for registration.

Professional Indemnity Insurance (PII) coverage is part of ANMF NT membership. If you are an independent practitioner please contact the ANMF NT to determine whether you are covered. Appropriate PII arrangements are essential for all practising nurses and midwives.

Since 1 July 2010 the Health Practitioner Regulation National Law (ACT 2009) has imposed a specific obligation on nurses and midwives not to practice unless appropriate PII arrangements are in force in relation to their practice. A failure to comply with this obligation will not only expose nurses and midwives in the event of negligence to the potential for uninsured civil liability but may expose them to a charge of unprofessional conduct.

If you are a financial member of the ANMF NT branch, you are an automatic insured person under the group policy for nursing or midwifery services as recognised by the branch and within the scope of your AHPRA registration and qualifications. This is automatic cover while you are a salaried person and/or PAYG. Usually your employer will have a Medical Malpractice & Public Liability policy, which will extend to cover you as an employee performing services on their behalf. In this instance, the ANMF NT policy sits secondary to your employer, where the ANMF NT policy is utilised if there is an issue with your employers’ policy or if it best you seek cover separate to your employer. An example of this might be if you feel your employer is not acting in your best interests.

If you are engaged as an independent contractor or a sole trader providing services direct to clients/patients, the ANMF NT policy then becomes the primary policy to respond. To have cover for this arrangement, you need to undergo the applicability process, where in addition to applicability form you also provide a copy of your qualifications for review and approval by the branch and then formal confirmation from our broker. This process is in place to ensure our members hold suitable qualifications for the work they are performing and in turn protecting the policy for the benefit of the membership cohort as a whole.


Professional Indemnity Insurance (PII) cover 2026-2027

The policy covers eligible financial members of the ANMF (Northern Territory Branch) up to 30 June 2027 at 4pm This confirmation is in force whilst the individual remains an eligible financial member of the ANMF (Northern Territory Branch). The limit of Professional Indemnity for any one claim is $10 million and $50 million in the aggregate, and for Public Liability, $10 million any one occurrence. Issued for the purposes of Section 129 of the Health Practitioner Regulation National Law that requires nurses and midwives to have appropriate professional indemnity cover in place for their practice.

Exclusions
The policy does not cover independent and/or privately practising midwives providing intrapartum care, non-practicing members or student members who are not working and higher education members other than when employed in a tertiary institution. Further, exclusions apply with respect to Botox and cosmetic Injectables; ear syringing, laser therapy; osteopathy; chiropractic and manipulative therapy; services rendered under the influence of intoxicants or drugs; and dishonest, fraudulent, criminal and/or malicious conduct. The full terms, conditions and exclusions can be found in the policy wording. Nurses or midwives in independent practice will not be covered unless they meet specific criteria upon application. The policy has been arranged by Edgewise Insurance Brokers Pty Ltd (ACN 120 673 261, AFSL 307654) and issued by Berkley Insurance Company (trading as Berkley Insurance Australia) (ABN 53 126 559 706, AFSL 463129) of Level 7, 321 Kent Street, Sydney NSW 2000 Australia.

Any Nurse or Midwife:

  • Could be wrongfully accused of unprofessional conduct in both administration and clinical roles

  • Could mistakenly give the wrong drug to a patient.

  • Could fail to accurately carry out all instructions for care in a busy ward

  • Could be involved in a court case even if only indirectly or witness an accident.

  • Could make a mistake because of workload stress, insufficient information, or any other reason.

The ANMF NT Branch's PII protects ANMF NT Branch members:

  • If you are sued for negligence or malpractice.

  • If you are required to give evidence at a coronial inquest.

  • Members of the ANMF NT Branch who are nurses, midwives and aged care workers are covered by Professional Indemnity - $10,000,000 any one Claim and in the aggregate (with four reinstatements).

  • This is the most cost-effective way for nurses, midwives, and aged care workers to ensure they are covered at work.
